Terms of Use of the Mobile Application
This text sets out the principles of processing your personal data by the data controller SHAYA KAZAKHSTAN LLP (SHAYA KAZAKHSTAN) (“Shaya” or “Company”), registered at 050000, Republic of Kazakhstan, Almaty, Timiryazev Street 28V, in accordance with the legislation of the Republic of Kazakhstan.1. Purposes of processing personal data
The personal data such as your name, last name and email address you provide by subscribing to our mailing lists and by requesting to be informed about the campaigns, latest news and announcements is processed for the purposes of communicating informative and promotional content, sending newsletters about product promotions or our Company's products and services, sending email messages containing advertisements, deals, offers and campaigns to you, tracking and analyzing business development projects in these areas, and engaging in marketing activities.
2. Methods and legal grounds for collecting personal data
The personal data provided by the data subject by subscribing to the mailing list to receive information about the campaigns, latest news and announcements is collected in the electronic medium, in part automatically, when the data subject enters their personal information in the newsletter subscription section. In accordance with the Law, this type of personal data is processed with the explicit consent that the data subject gives by subscribing to the newsletters and based on the legal grounds for obtaining the explicit consent of the data subject pursuant to the Law of Republik of Kazakhstan.
3. Transfer of personal data and purposes of transfer
The purposes of processing personal data are similar to the purposes of transferring personal data. The personal data that our Company collects in order to fulfill the purposes specified herein may be transferred to partnering organizations to carry out its activities, to individuals and institutions at home/abroad if the data is stored in the cloud, to partnering organizations at home/abroad for transmitting commercial electronic messages, to public authorities if requested by a court order, and to relevant business partners in accordance with the data processing provisions regarding the transfer and purposes of personal data.
4. Rights of data subjects and how to file a request with the data controller
In accordance with the Law of the Republik of Kazakhstan, data subjects are entitled to:
a) ask whether any of their personal data is being processed,
b) request information with regard to the processing activities,
c) ask the purposes of the processing and whether their personal data is processed within the scope of such purposes,
d) in the event their personal data is shared with third persons within or outside the country, request information on such third persons,
e) request correction of the personal data if the data is processed incompletely or inaccurately and request notification of the transaction made within this scope to third parties to whom personal data is transferred,
f) request the deletion or destruction of personal data if the reasons for the processing of the personal data no longer exist or if the Company has no legal grounds or legitimate interest to process such data,
g) request notification of the transaction made within this scope to third parties to whom personal data has been transferred,
h) request from the company to ensure that the third persons who process personal data under the authorization given by the company respect their rights described under this section,
i) object to negative consequences that may occur as a result of the processing of personal data by automatic means and demand the compensation of the damage in case of damage due to unlawful processing of personal data. You may also exercise your right to unsubscribe from the mailing lists by clicking the unsubscribe link in the email.
In accordance with the principles of filing a complaint with the Data Controller, you can submit your requests to exercise these rights by sending a letter to the company's address csupport.kz@alshaya.com
The Company will review and conclude the requests as early as possible and within maximum thirty days, depending on their respective nature, with the first request processed free of charge. However, in the event that the first request or the ensuing requests regarding the same issue involve additional costs, Shaya reserves the right to charge a fee. The Company also reserves the right to accept and process a request or reject it in writing by stating its justification.
In the event that the request filed in accordance with the above-mentioned procedure is rejected, the response is found insufficient or the request is not replied in due time, the data subject reserves the right to file a complaint with the Personal Data Protection Board ("Board") within thirty days following the delivery of the response and in any case within sixty days from the date of submission. However, a complaint cannot be filed before the legal application options are exhausted.
